Me - EB2 Labor pending applied May6th 07.
My Wife - EB3 Labor and I140 approved (PD Dec 2006)
What should I do? Thanks in advance.

If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.

The whole idea of this campaign was to get media attention and publicize this issue as much as possible, which we all know that it did just that quite effectively despite all the apprehensions and reservations expressed.
This campaing was never thought of as a panacea for all our problems, whether it will lead to a fruitful or POSITIVE result that is still unknown. What is known is that this drive has provided some much needed traction and attraction to our cause, which is the important RESULT at this point in my opinion.
All I am trying to say is that we should give some thought and imagination before discounting or discarding an idea even if it appears to be far fetched at first. Any idea proposed which is out of the ordinary will be meted with reservations and oppositions, after all its nature's law that there is always resistance to change,:rolleyes: good or bad.
I don't want you to be eating your words :D , I know for sure that you want this problem resolved as much as anyone else on the forum.:D
Everyone has right to be SKEPTICAL and even I am SKEPTICAL about the final outcome of our over all struggle, but I wasn't SKEPTICAL about the outcome of this campaign.

Yes I was the one who suggested the dead fish. I belive in RESULTS, if sending these flowers actually ACHIEVES something, I will make a nice big biscuit of my words and eat them :).
Until we see ACTUAL "POSITIVE" RESULTS I am still going to be skeptical. Sure we have made a lot of noise and it has been heard by a lot of miscallaneous people. So were the rallies held by the illegals. What happened? NOTHING! So until I see some results YES I will STILL be skeptical.
Other than that, I really really really hope for everyone's sake, that this works and if it does I will eat my words and become a believer:)

The law comes actually down to the following two rules:
(1) horizontal spill if visas available
(2) vertical spill for visas not required
The language in (2) is much stronger. A visa number that is still available cannot be required at the same time. So one could argue that DOS is now misinterpreting the law.
Everyone wants to interpret the law as per their wish. It is nature. However, there is a unbiased place to find the solution for right interpretation. That is called court. Discussing, how DOS/USCIS should interpret the (INA) law in this forum will not yield any result. Even if you contat DOS/USCIS, they will simply say "this is what we understand the law, we have no rights to change the law". Flower or letter campain will not work. If you feel the interpretation is wrong, the only solution is court.
My recomendation is simple. To end retorgression in EB3, it just need more the number of visa. Current INA will not help EB3, and so DOS/USCIS. Only law makers can help to change the situation, by adding appropirate provisions in INA to create more numbers in EB3. Contact law makers. This is the good way of spending your effort. USCIS/DOS does not have enough power to change the law.

Interviewed last September (2009), when I was told that my case is approved and waiting for visa number.
Second fingerprint on September 20th 2010
Lawyer was told that my case is being "held" since there was no visa number available after my 2nd fingerprint cleared, so I wasn't expecting anything until Oct 1st, so was obviously pleasantly surprised.

Can anybody pls help me with regard to my situation.As my kid was born in india Whether i need to apply employment authorisation/EAD (I 765 application) for my kid..We asked the attorney she told u can do what ever u want.Anybody in this situation?or anybody have applied EAD for kids under 14yrs ?

I read in another forum that US consulate in Canada is actually asking to fill out some PIMS form available on their website. Also you need to fax your documents 1 week prior to your appointment.
Can anyone confirm this? Man, I wish this could be the case in India also. :confused:
in mumbai, also you need to enter the details of petition online (petition number, expiry date and petitioner name) while booking appointment.. and you need to submit all documents before 5 working days.. (in some cases they mention 3 working days)

When you ask for advice, you need humility. Not call others stupid, when it looks like you made the same mistake. You bought a home which you were in no safe position to afford. There are people who didn't buy because they saw what was coming. Can these guys call you stupid because you didn't see what was coming? I don't know why my tax dollar should be used to bail out guys like you who are/were irresponsible, while I patiently rent out this mess caused by you guys? :mad::mad:

It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.

Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2.

I doubt the USCIS has any rules regarding processing queue. Some people are waiting 10+ years, others receive approvals in 2 months.
My understanding on this is - after I-485 uscis works on RD and if your FP/NC is cleared PD is looked at for preference in each category but uscis won't wait guy stuck in nc for 10 yr to make way for your gc. If you are lucky you may get it sooner than you expect

13 years since I landed in this country.....finally, I got the approval email 15 minutes back. I am not sure how to express my feelings (or lack thereof).
I want to thank the following guys from the botton of my heart.
1) KubMilegaGC - who gave me support in September or was around for sometime in October to check on my status
2) SeekerOfPeace, KewlChap and fatjoe - for all the valuable information they have provided. Thank you so much guys!!
I did the following:
1) Took around 10 Infopass appointments, with the last one being today morning at 9 AM PST. IO told me that my case was under review since July 2009.
2) Attorney reached out to AILA liaison
3) Sent DHS-7001 to CIS Ombudsman
4) Letter requesting USCIS secretary Napolatino to inquire about the delay in my case
5) Letter to first lady last weekend requesting to inquire about the delay in my case
6) Several inquiries were made by Congresswoman on my behalf
7) Inquiry was made on my behalf by the senator
8) Opened several SRs - I think around 6 or 7
As a result, I now have around 30 different responses from USCIS/DHS. Looking at each response, it makes me believe that they have not even cared to look at my case and have just pulled out a response from a standard set of responses.
I believe what really helped me is a phone call using the POJ method to TSC. I was fortunate to get a hold of a very nice and polite IO. IO walked me through the entire process and to my utter disbelief told me that my case was still sitting in the storage area and collecting dust (this was 2 weeks back). While I was on the phone, the IO sent a request to the folks in the storage area to pull my file out. Luckily for me, the file was in one of the storage areas in Texas itself. Once the file was at the Texas service center, it sat in the holding area for almost a week . It seems like the officer picked up my file sometime at the end of last week or earlier this morning.
Edit to the post: In hindsight, I think the delay in my case was because I had 4 I-140s (2 from RIR labor and 2 from PERM, one each for EB2 and EB3). I think whenever the IOs looked at my file, they thought that my case was not current. The IO I talked to specifically put in a note for the IO to look at the EB2 140 (June 2004) and not the EB3 I-140 (June 2004) or the I-140s that I have from July 2005. I dont know what to tell my attorney, not sure why they had to file 140s in EB3 for me.
Once again, thanks to everyone who has supported me to get through this painful process. Last 60 days (since September 1st) have been very painful for me.
Good luck to all EB2 who are still waiting and to all the EB3 folks, I hope you guys become current soon and get your GCs - I really really admire your patience.
Keep the faith.....

I think we can continue arguing this till we are blue in the face. We already have like 8 pages of discussion on this. I never had an employer pre-screen me on immigration status, doesn't mean it never happens.
We have immigrationvoice1, chandu, BharatPremi who feels they have been discriminated against based on EAD. We can collect more stories and bring it to the notice of the govt. Everyone who have been discriminated can and should also go ahead and file a complaint individually.
Let the govt decide if they can pursue based on what evidence we have. Lets not keep on discussing what the outcome will be. Lets try to do what we can.
If anyone (and I am not pointing a finger at BharatPremi) doesn't feel anything can be done, fine move on. Other who see hope, lets take the first step and inform the govt.

My friend: We are one people. We all came to the US with similar dreams. There are many who came before us and are patiently waiting their turn. The issue is not yours or mine, its OURS. It is our duty to fight this injustice and provide equal access to all. Learn a lesson from the jewish community. They pretty much run this country.
I'm EB2/ Masters from US school and in my seventh year H1-B.
