JUAN GONZALEZ: Well, Id like to move on. I want to play a report from your show covering former Mexican President Vicente Foxs May 2000 visit to the United States. Your reporter Casey Wian
LOU DOBBS: Wian.
JUAN GONZALEZ: Wian, Im sorrydescribed the visit as a, quote, Mexican military incursion. This aired on May 23, 2006.
CASEY WIAN: This Mexican military incursion was fully authorized. A Mexican air force jet carrying President Vicente Fox was not just invited to Utah, but encouraged to visit by Governor John Huntsman.
PRESIDENT VICENTE FOX: We fully support the businessmen from Utah and Mexico
CASE WIAN: Its estimated Utah has about 100,000 illegal aliens, and the number is growing rapidly. Utah is also a part of the territory some militant Latino activists refer to as Aztlan, the portion of the Southwest United States they claim rightfully belongs to Mexico.
You could call this the Vicente Fox Aztlan tour, since the three states hell visitUtah, Washington, and Californiaare all part of some radical groups vision of the mythical indigenous homeland, Lou.
LOU DOBBS: Casey, thank you very much.
JUAN GONZALEZ: The Southern Poverty Law Center criticized CNN for airing that report, in part because, as your reporter Casey Wian spoke, a graphic appeared on the screen. It was a map of the United States highlighting the seven Southwestern states that Mexico supposedly covets and calls Aztlan. The map was prominently sourced to the Council of Conservative Citizens, which is considered by many to be a white supremacist hate group.
AMY GOODMAN: Your response, Lou Dobbs?
LOU DOBBS: You know the response, and you know the reality. Thathow long was that screen up? How long was that map up?
AMY GOODMAN: Enough to see it.
JUAN GONZALEZ: A few seconds.
LOU DOBBS: The field producer whodid you know it was from the CCC? Which is a hate group.
AMY GOODMAN: Its attributed right there. It says Council of Conservative Citizens.
LOU DOBBS: Right. And it couldnt be clearer, could it? I mean, we werent hiding anything. We had no idea what they were. The field producer who used it went on the web, pulleddid a grab, as its called, and put it up. And she was suspended for a day for doing so.
Did you guys know that we have sent our producers and our reporters down to the Southern Poverty Law Center years ago to make certain this sort of thing doesnt happen? Thats how seriously we take the issue. And for you to talk about the incursion, you forgot to point out that that was coming out of rather jocular discussion of the incursions by Mexican forces along the border and the response of the US government.
JUAN GONZALEZ: But
LOU DOBBS: And, I mean, are you offended?
AMY GOODMAN: Lou, did you say you have no idea what the Council of Concervative Citizens is?
LOU DOBBS: Did I say I dont?
AMY GOODMAN: Yes.
LOU DOBBS: I certainly do now. Absolutely. What did Iyou didnt hear what I just said?
AMY GOODMAN: I just want to
LOU DOBBS: Theyre acknowledged as a hate group. Absolutely.
JUAN GONZALEZ: See, but the problem, this
LOU DOBBS: What is the problem here?
JUAN GONZALEZ: Projecting the image to your viewers that theres a Mexican desire to reconquer, the Reconquista of the Southwestern United States, does create imagesand especially in people who are not necessarily as intelligent as you necessarily or who have studied as much as you have
LOU DOBBS: Thank you for conceding that.
JUAN GONZALEZ: that the country is under siege.
LOU DOBBS: My god, are you so self-important that you dont think people have a sense of humor when Casey Wian says this is an authorized incursion by the Mexican government? You dont think people have a sense of humor about that? The reality is, I think most people do. The other thing is, who are you trying to protect America from? Im a little confused, because the reality is that there is a strong radical group of Reconquistas and Aztlan aficionados, and I have had them demonstrating against me in a couple of cities over the past few weeks. Dont sit here being disingenuous
JUAN GONZALEZ: Im not.
LOU DOBBS: and sanctimonious, because, let me tell you something
JUAN GONZALEZ: Im not being disingenuous.
LOU DOBBS: there are many idiots on either extreme of this debate, and dont kid yourself
AMY GOODMAN: But, Lou, I think whats important here
LOU DOBBS: and you know it.
AMY GOODMAN: once again, is the pattern. Its the pattern
LOU DOBBS: The patterncome on, please.
AMY GOODMAN: No, let me make my point, because what I talk about is facts.
LOU DOBBS: OK, lets look at the pattern. The pattern is, for five years, weve been reporting on illegal immigration. The pattern is that we have been reporting on the impact of illegal immigration. It doesnt suit your partisan viewsand thats understandableor your ideological views. But dont get carried away with yourselves, for crying out loud!
LOU DOBBS: Wian.

By Mr. Cannon:
"NNCPS is partnering with other Agencies to provide contractors and personnel to process name checks. For example, the FBI and USCIS have implemented a key initiative to use contractor resources to prioritize the processing of "Single-Hit" USClS Name Check requests, that is, pending name check requests that have only one FBI file potentially identified with it that needs to be reviewed in order to process the request. By applying contractor resources to process these "Single Hit" requests, the FBI may significantly reduce the pending USClS name check workload."
Declaration of M. Cannon filed in one of the civil cases in Northern GA, dated October 4th, 2007. To know for sure you have to have a pending lawsuit and send a discovery request to district US Attorney.
First of all, lazycis, thank you for all the great information on the immigration portal WOM thread and now on the IV forums. The community owes you.
Re: this Cannon declaration -- do you mind sharing the case number or case name (X v Chertoff) or the declaration if you have downloaded it from Pacer?

I will participate in this wholeheartedly. One suggestion to the admin: perhaps we can post this in other websites also like ? I know a lot of people use that site for posting problems etc and whoever is not in IV might also get to know about it.
Good idea. Please feel free to post this information to as many websites, forums and blogs as possible. Please do not restrict yourself to websites in english language. If you know of websites in other languages frequented by EB immigrants, please post this information. The mantra for success in this effort is getting as many letters as we can.

Finally got the CPO emails/texts today morning for both me and my wife.
Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
All GC applications in EB2. Nationality : India.
Applied in Mid 2001 : company (think $15B!!!) went kaput.
Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
Applied Nov 22, 2005 : Approved Aug 11, 2010.
Labor applied via PERM - approved in about 4 months.
I-140 applied soon after - approved in about 4 months.
I-485 applied during the July-August 2007.
Receipt Date: Aug 16, 2007
Notice Date: Oct 1, 2007
At NSC.
Quit in mid-2008 with 485/EAD, sent AC21.
Got RFE in Sep 2008 (missed the 2008 boat).
485 LUD stuck at 10/29/2008 forever until today.
Opened a SR on Aug 5th.
Took an infopass on Aug 6th - all I could get was, "your application is with an
Immigration Officer since Aug 2nd". Nothing else!
Don't know if either had an effect.
Didn't do anything beyond the above two.
I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.
It has been a long journey for sure. A lot of my friends who came to
USA in 1996 are now citizens. I have NO regrets at all. I took my own
path. Sometimes I used to think that if I had done the GC process
in 1998/1999 instead of quitting my full time job to do full time masters,
I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
sure, it would've taken longer to get even the Labor cleared but I would
have gotten GC in probably 2007 - and worst case 2008. And heck, I would
have made an additional $150K (since the company got acquired by "as big
as it gets" tech company). OR what if I had chosen a very safe choice out
of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
every body else got 12 offers as well]. OH btw, the full time masters ended
up costing me about $45K in credit card loans. So yeah...no point in contemplating
all the "coulda woulda shoulda"s in life.
As Nike says: Just do it.
I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
of that to the current one - where I am extremely happy and think
will over time come out very well off too.
At all times, I never compromised on my job. Took the job which offered
me the most challenge and allowed me to learn as much as possible while
working the smartest folks around. That I think was a great benefit - all
along - since that component of life (work) never bothered me. And was never
afraid of taking (apparent) risks either. To me they were calculated risks.
The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
When I quit it was 450+ folks and was about 750+ when it was acquired.
The company I joined in 2008 (via AC21), was and still is a startup. When
I joined we were 8 employees and still now, remain lean-and-mean but
kicking some serious ass. (if I say so myself..pardon me). :)
The biggest hiccup as I think of it now was that my wife was not able
to work from 2003-2007. But the EAD in mid-2007 finally solved that
problem. Oh, I never hesitated traveling either : travel to Africa (three
countries) one year, and to Europe (three countries) one year and
Asia (two countries other than India) in one year.
Also purchased a home in 2009 (it was very tempting during the
2004-2006 times...but waited out for good).
So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.
A couple of times I had contemplated Canadian PR or really
moving there or to somewhere in Europe (and even Aus PR).
But pursued nothing mostly because I was lazy.
But all along my wife fully supported in everything I (we) did.
Be it change of jobs, other big decisions..what not.
So thankful to god for that.
Just a bit to go back in the way back machine.
Long ago, labor was the bottle-neck. Then 485, then something else.
Things repeat - old is new, new is old...repeat.
There were times when there was no online checking, no sms, no email notifications.
Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.
If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.
A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]
Good luck and all the best to those who are waiting.
EB2-IC seems in pretty good shape as far as I can tell.
EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.
And finally: Be Happy!
Peace.

I received a similar response to the 2nd SR. I was told that my case was under additional review and to allow them 60 days. However, my wife's case had been assigned to an officer for review.
Did you send an email to TSC.Ncscfollowup@dhs.gov (for TSC - another email for NSC). I had no clue where my application was when even 2006 cases were getting approved. I am seeing some movement after emailing them.
Gurus,
I received a SR reply in mail that my case is under additional review . MY pd is sep 05 and i am so frustrated. They also asked to check back after 4 - 9 months. Is there any body in that situation and what else can be done .. please advice..
Thanks

always amazes me how so many folks depend upon these immigration attorney websites and get disappointed...we are better off supporting IV advocacy and get first hand information on what is going on in DC, USCIS and DOS.
This is not the first time and I'm sure it won't be the last time these AILA folks generate sensational news! Help IV to help you!
Exactly. It's like some have gone berserk on the possible 12K unused visa bit. There are scientific (perhaps, even astrological) calculations, assumptions, predictions from lawyers, "Gurus" and just about everyone else..yet, the support to help IV, in order to help each and everyone is minimal to non-existent. Isn’t being at the Advocacy day (or contributing to the day) -- speaking to the powers-that-be, the MOST effective way to get the backlog issues addressed?! It all feels a bit headless chicken central.

After we landed, the passengers were asked to exit the aircraft along with their carry bags. Many of us were puzzled as some of us wanted to catch up with our sleep. Reluctantly everyone had to leave the aircraft. Someone was saying there is another aircraft waiting to take us to India. Makes sense, that is why they asked us to take our cabin bags too. After we entered the building we were asked to take the left door. Behind the right door was a waiting room. A couple of turns led us into a corridor which was probably about 1/2 mile long. At the end of the corridor there was security check. Again I was puzzled, why security check now, we are already in a secure area. The transit visa form with those 111 questions suddenly came in front of my eyes. Nothing less than a new complete security check will satisfy these neurotic people. It was time to go thru the exercise again. Took off the shoes, wallet, coins, Jacket, belt, pants .... when I was gently reminder by the security guard that it was not required today. When my turn came to send the items thru the machine, I complained about the fact that I have to put my jacket in a bin that was probably used earlier to keep someones shoes. (And you know where the shoes go. And sometimes when it gets wet, it is not necessarily because of water. The thought itself was so revolting that I decided to get my jacket dry-cleaned after I reached India). Needless to say my protest landed on deaf ears. After going thru the security gate, it was time to go thru the final check. I assumed the flying eagle's position and was quickly scanned and cleared. Beyond the security point was the shopping and restaurant area. I was bit thirsty but could not force myself to spend on a bottle of water. I was so put off by this whole experience that I did not want to spend a single cent here. We looked at the monitor to find our gate and quickly proceeded towards it. Again we walked for about half a mile or so. Things looked familiar, but I quickly brushed off the idea. At the gate we presented our credentials and were admitted into the waiting area. Then again I got a sense of dj vu. I soon realized it was the same freaking waiting room that I saw earlier and the same aircraft was waiting for us. We needlessly walked for more than a mile, subjected ourselves thru security check. All this for what?
After waiting for an hour we were allowed to go into the aircraft to the same seats and surrounded by the same little pieces of garbage still on the floor. I congratulated myself for not buying the water bottle and looked out of the window to say final goodbye to London. Never again! Never.
Brit's think they are born twice & superior to the world and they can do better job in security checks then Americans....or as a matter of fact then any one else in the world?
I am not saying there shouldn't be any security checks but one thing is not clear or don't understand why do we have to go through security check process when nothing has could have changed in between flight take off from US and landing at Heathrow airport..I feel the possibility of someone getting into flight after its take off is ZERO chance....
What irritates me is when I travel through AIR-INDIA (proud passenger since 2001) stopover at London is right in the middle of night..you will be in deep sleep when it stops in London for fuel refill or some s*$^ we have to get down from plane and go through security check..it's so annoying I don't know when these security checks/stunts will STOP!!
After waiting for an hour we were allowed to go into the aircraft to the same seats and surrounded by the same little pieces of garbage still on the floor. I congratulated myself for not buying the water bottle and looked out of the window to say final goodbye to London. Never again! Never.

Guys,
Any idea when the new proposals will be implemented if they become law  Do we have to wait until Oct for these new proposals to take effect.

mchudi,
These are very tough and partisian bills (immigration bills). This also being an election year, some lawmakers will try to puch their own agenda. Don't expect a featherbed solution. This will be a dogfight.

I just received my 2 year EAD. Priority date is Nov 2002 - EB3 -India. Well I guess that says it all. If USCIS thinks that Nov 2002 will take at least another 2 years then I dunno what about the rest. I didn't wanna think about EB2 porting being so close and spend another 10k, I guess just need to stop worrying about it now. :)
It will be 10K spent well if you decide to do that!

So per your theory 8008 people who filed in Eb3 should get approved which should bring it to 2003? for EB3-I by end of year?
EB3 india gets only 2803 per year with350 of those going to OW. How did you arrive at the figure.

So what are the alternatives?
Yes true but passing of Vise arecapture bill is like waiting for 'Kumbhkaran' to wake up, they've been sleeping for 4-5 years what is the gurantee that they'll not sleep for another 5 years on the immigration bills ?

My PD is 2005 but I have been in this country for 10 years now....There will be lot of people like me....If you really want to see FIFO USCIS should impement PD as the first arrival date..some of the ~2002 folks will be upset as it will push them down the PD list...
This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
So life is not always easy. There are people waiting since 2002-03-04.
Don't think that life is not a FIFO always.
Why some of the guys became violent when I said, INDIA IS GREAT???
Guys.. do you know why I always feel like this???
As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.
Someone asked me to pack up... YES, I will if nothing happens;however, I will be waiting to see the progress for sure. This is July. Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".
Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.

After seeing the May bullettin, it seems what the US is actually giving us is either a A kick in the back or a slap on the face?
May be we can create a poll for that send the results to the president.

I know the rules of car buying and hence mentioned the word hypothetical - however, as I said earlier, I agree with your basic principle that we are liable for whatever we signed up for and if you look at my first post on this thread that is exactly what I suggested to punjabi77 i.e. Is renting an option?
If we strictly go by the purpose of this thread - yes, we are in agreement that punjabi77 should look at alternative ways of paying off his mortgage or just simply sell his asset with a ~20k loss.
Peace :)
Some Rules:
Rule 101 for car buying: Value depreciates moment you walk out of show room. How much it will be, no one can guarantee you and no one but you are liable for depreciation.
Rule 101 for Home buying: Value of the debt you sign will remain unchanged
while the value of asset may erode.
Rule 102: House is a secure debt: meaning if you don't pay the house will be repossessed by bank. So you have to pay to play.
Do you know there is no earthquake insurance in California so if you loose your fully paid house in earth quake you are left with ZIP !!!
Mother of all Rule: Don't get into the any game without knowing the rules.
Now some clarification: The money Punjabi77 own to the bank is actually already paid to the builder or seller (previous owner) by the bank. Bank gave away that money just by a stroke of signature of Punjabi77 and in return for future interest payments. So the asset value on the book is what Punjabi
owes not a penny less and not a penny more. If they reduce the asset value to make Punjabi77 feel better it will be taking loss for him ? Why should they do it ? Should they take it back from builder and where do we stop ?
We can demonize lenders, Wall St and everyone all we want, but this thread is not about them. This is about punjabi77. But I don't know why it is so hard for us to just accept that we screwed up, got enticed made a mistake and start to fix it. Stop the blame game for once. I can attribute all my problems to someone or the other but how does it help me ? The sooner I accept them and start to work on then better it is for me.
