Its not a legal loophole. Some states just do it that way. Their under pinning argument is that you are on a temporary visa and does not have permanent residency. Also, its not the University that makes up the rules. There is some thing called domicile office in most schools and they determine residency for in state/out of state purposes. The domicile office has specific set of instructions on how they should determine eligibility requirements for in state. For example common wealth of VA has state council for higher education (http://www.schev.edu/Students/VAdomicileguidelines.asp?from=students) that provides these guidelines. Check out what AZ has to say and if they say only permanent residency is a requirement to be eligible for in state, there is nothing much you can do.
Also, its not a federal violation as states decide what they want to do with their university systems. If you want you can write to your state senators and assembly man and see what they have to say. Its very difficult to explain them these nuances when there are a bunch of people crying out loud that many illegals are getting in state rates.

People: I called up a doctor in NJ and the next appointment date was 1st August. Then I tried few more numbers and ph just kept ringing. Finally I called up a doc in NYC and got the appointment for this Friday (June 18). He charges $190 per person. Here are his details.

Are there any runners, joggers, walkers out there? Has anyone heard of running teams like Team Leukemia, Team AIDS, Race for the Cure - Team Susan G Komen??
Well, I would like to propose a Team IV. There would be a nominal fee, say $50 or $75, to join the walking/running club and you would get one running T shirt (with IV logo) to wear at local runs/walks. This way we get our name out in the community. And just like Team Leukemia, each Team IV member will conduct 1 fundraising event per quarter or per 6 months. At the end of the fundraising year, we should donate a portion of our collections to a local or national charity. The donation will come from Immigration Voice. This way, Immigration Voice members have another reason to be proud of what we bring to the plate as employment based legal immigrants.
If there is such a running/walking team out there, please let me know as I would love to join and support the cause. If there is interest to establish such a Team, please let me know.

You must have noticed that in any society, the extremely rich or the extremely poor do not follow any rules while the 'middle class' follows all the rules and gets screwed. :(
So it shouldn't be surprising that we are getting this 'mad' deal after years of following rules. Am not justifying it but that's the sad reality and we live with it every day. We need to do our best to try to change it. Try keeping your spirits high.
In addition, it could be that the U.S. is slowly becoming a land where 'unskilled' workers are more valuable since they already have a pool of adequate 'high skilled' workers in addition to many of the 'high skilled' workers living overseas (due to outsourcing). So what seems unfair to us maybe the harsh reality on the ground. Maybe, they don't want this additional pool of 'high skilled' workers anymore. We may be living under the wrong assumption that 'high skilled' workers deserve a better chance in the U.S.

I know of a colleague who lost her father but could not go to perform the last rites because she did not have the H1 stamped and the earliest appointment that any consulate in India was giving her was 4 months away.
She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ.
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.

Great thread! By the way, you can't join the illegal queue anymore since you had to be illegal by the beginning of this year, and longer you have been illegal the better! Haha! So with your less than 1 year illegal status, you'd probably be still left at the end of the queue along with the legals. And if you've only been without status for a few days, you're probably screwed the worst!
This law is a testament to how poorly the Congress understands what they are doing. Instead of fixing the broken law, which needs to be cleaned up, simplified GREATLY, streamlined and made consistent with both itself and other laws, they're just adding more of the same on the top. This will make the law even more complex and even more people will fall in between the cracks in the future.
This proposal needs to be trashed completely, forget the small measures of raising the caps, etc... You're only putting a bandaid on a gun shot wound. They seriously need to go back to the drawing board and REFORM the ORIGINAL law.

Dhirajs98- I am sorry I dont know about checks cashing because we are doing through a company attorney - company pays for our GC expenses..But we filed for I-485, EAD & AP on June 29th, We got our receipt numbers last week. From the time we got receipt no's we got EAD & FP both within a week..

I understand that your intention is to get heard. I appreciate your effort at writing letter. However writing to the president will not help us much. Here is why:
In the USA, infact for that matter in most democracies, Laws are made by elected representatives unless it is an executive order to grant an immediate relief.
The composition and powers of the House and the Senate are established in Article One of the Constitution. The major power of the House is to pass federal legislation that affects the entire country, although its bills must also be passed by the Senate and further agreed to by the President before becoming law (unless both the House and Senate re-pass the legislation with a two-thirds majority in each chamber). The total number of voting representatives is fixed by law at no more than 435.[1] (United States congressional apportionment - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/United_States_congressional_apportionment))
So, In our case, the president at the most can sympathise with our cause and the hardships we face because of the limbo, But he cannot really help until there is a bill that passes both the house and the senate.
So, Can I suggest that it will be even more worthwhile if you contact your congressman/woman and go meet them. We need them to understand our plight and anguish.
We all need to go meet our lawmakers, educate them.
They already are educated. Do you think they do not know about us?
They fully know about us. But they will not help us because we are not voters and cannot contribute.
A better idea is to have our employers contact them. People working in large companies can do this. I am surprised why the big companies have not taken up this issue for us. Why cannot we have big companies issues statements in our favor?
