Yes we can consider that too for our argument. 10 years in another country without citizenship is meaningless (most important part of our life is being spent here).

Because you still need a visa to enter the USA (though you have an H-1B approval) and application for the visa abroad is not always easy.
But if your visa is stamped and not expired, do you still need an AP ?

You are funny....you should take the moral high ground only when you are on the right side...you gave morally/ethically repugnant suggestions and have "decided not to reply to any of the comments here"...very funny.
I do not condone the pathetic language folks here use including from sledge_hammer. You can make your arguments with civility. No need to call people "fools", "idiots", "stupids" etc. Shows your own under-confidence and lashing out at the wrong things/people.
GASleuth..
this thread was started to get suggestions as to what are the options open in the market..
if someone did give an option and you dont like it, why dont u give an alternative option rather than venting out uour anger.
No one is asking you how u feel or what is ethical and non-ethical..It seems that you are such an ethical guy who has not used a product and went ahead and returned it back to the store..If foreclosing is illegal let me know.. People here are giving pros and cons of doing a foreclosure.. i dont know if you own a house or not, and if you do.. dont know if you are having a perm job or a contract..I know so many people who own house and now they are in a fix because of housing market..I am not like other people who have already foreclosed..and btw.. why to blame the people and not the banks.. if i can own a house and pay mortgage which is quite same as a rent, i will better own a house and sell it after couple of years.. what is harm in that.. i may have mentioned about making profit by owning a house.. but i am not looking at becoming rich by living in a house for 2/3 years..Sledge_hammer and you are complaining all the way in the thread about people who are foreclosing or foreclosed.. but not spent your valuable time in letting people, reading the thread, know what are pros and cons of foreclosure and how it can affect 485..

You got it absolutely right.
The only way out is legislation. Even this eb2 trend of approvals will end come october.
With the earlier method or the current method, EB3-I will always end up last. Vertically EB3-ROW gets the excess visas (old method), horizontally EB2-I gets the excess visas (new method). So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.
For us, visa recapture or other legislative changes are the only relief.
BTW, my PD is June 2003, EB3-I

These assumptions marked in red are incorrect. ROW has been consolidated into 1 category to simplify the visa bulletin. ICMP countries exceed the quota, that's why they have separate entries. If another country exceeds the quota U.K. for example, then it'll have it own column in the visa bulletin. The quota for EB-ROW is 40K - per country limit for ICMP for that category X 4. That's why EB3 India has been getting screwed ever since they re-interpreted the spillover rules (in the middle of 2008). Otherwise, you would see EB3 ICMP get at least 8K GCs in 2009.
1) Each (EB1/2/3) - 28.6% WW quota = 40040
2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
) Assumption - USCIS distributes equal share amon3g these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.
Example:
EB3 All = 40040 ( 0.286 x 140000)
EB3 ALL = EB3 I + EB3 C + EB3 M + EB3 P + EB3 ROW
Assuming equal share of all of these 5 subscription categories - 40040/5 = 8008 applications to be worked for "Assigning the visa number" not " for granting the visa (IN other words physical greencard order)"
7% + 2% = 9% country specific limit is meant for "Granting the visa - Ordering Physical Green card" out of "Applications which have been assigned a visa number" NOT FOR "Assigning the visa number"

WASHINGTON (Reuters) - Disgruntled green card applicants from India sent hundreds of flowers to the U.S. immigration agency on Tuesday to protest a recent policy flip-flop that hurt their quest for permanent residency.
The campaign that directed around a thousand flower deliveries to U.S. Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez was modeled on a popular Indian film promoting the peaceful protest methods of Mahatma Gandhi.
The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.
Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.
The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.
"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.
FLOWERS SENT TO SOLDIERS
Gonzales said in a statement on the USCIS Web site that the agency would forward the flowers to Walter Reed Army Medical Center and Bethesda Naval Hospital in Washington, D.C., the main facilities treating U.S. soldiers wounded in Iraq and Afghanistan.
"We welcome the fact that the director at least acknowledged this campaign and we are happy that our flowers will be bringing some color to our soldiers in those two medical hospitals," said Vikas Bajaj, a software developer in Wisconsin who helped organize the flower protest.
Although Indians staged the flower protest, the green card application setback affected skilled workers from China, Poland and many other countries.
Mundru and other activists said hundreds of thousands of people shared his state of limbo. Many were unwilling or unable to buy houses or start companies until their residency was secure, they said.
The situation of foreign professionals working in the United States while awaiting green cards was sidelined in this year's contentious immigration debate, which focused on illegal immigrants, Bajaj said by telephone from Wisconsin.
"We have never been in this country illegally, we are hard-working, we are skilled immigrants -- and yet very little space is devoted to our issues," he said.
"The irony is, in this whole migration debate, our issues are probably easiest to solve," said Bajaj.

in childhood, then no need for varicella vaccine. You see, it is not very useful / protective and so I guess it is not insisted upon.
Use DD (due diligence).
All you said is correct, except for you don't need Hepatitis B if you are over 16. No, there are no more tests involved, unless your tb is positive. If you tb is positive you need to do chestX-ray. I know that because I was just doing the tests for myself. Varicella must be taken twice 30 days apart. Same applies to MMR.
I hope this helps. If you go to a good doctor, he will give you a complete list of things that you need to do before coming on the medical exam.

Final price for vonage would be $33.
still going for VONAGE makes sense as I can call india without "minutes counter" ticking over my head. I may wait for Lingo offer as it is even cheaper and offers flexibility to call india from cell phone too.

That suit will not stand a chance, not becasue it doesn't have legal merit but because it goes to the core of capitalistic system. Coporations can choose to hire and fire anyone as long as they don't fundamentally descriminate in writing. All of us know, that employers and hiring manangers have their preferences that might actually border legal descrimination so this is not an immigration issue as I see it. This is a broader issue linked to the power vested to the corporations in a capitalistic society, I have seen ethnic bias, age bias and all other kind of non-sense in hiring. Anyone claming that this doesn't happen or this is an immigration issue is simply in denial. It is just the way of life. As BharatPremi has pointed out, law says descrimination in the documents after hiring is illegal but it doesn't say that employer cannot choose to hire anyone as suited. Equal opportunity hiring practices are just guidelines which says job requirements MUST be uniformly and consistently applied to all race and color. It doesn't say you cannot choose to have an all white or all black work force. Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.
Using the same logic, they can avoid interviewing an African American.
I think we all should get together and file a class action law suit against those companies.

what makes you think they cant blame USCIS statistics for this? USCIS gave us wrong stats, we made it current, then they said that no, they have enough visa numbers.
I have not thought so. I guess that was your assumption on my post. As I said, it can very well happen, but I doubt it on the first day.
its not written into law that they cant update it mid-month. They are allowed by law to update it whenever they want.
Thanks for the info. As I understand, its not written into law. But if they really do it on the first day of the month, Its the best avenue for a class action law suit on both DOS & USCIS. It shows their negligence and incompetence to produce a VB that gets revised on day one. All the money spent by applicants, time spent by lawyers will definitely result in a pretty good number of people forming an alliance for a class action law suit.

THe reason USCIS is showing low numbers for the reason that , no one will then raise the question for recpature. Looking at the numbers they will say, O, the numbers are so low, whats the need for recapture and we will be left hanging cold and dry.
This is a plot of a well planned strategy.
So the question araise is why the dates are not moving or not current?
