what is the deadline for the final letter and when can we start the campaign.
Also I would really appreciate if someone can post the instruction on how to send the fax.. step by step so that the non IT layman also can do that.

We have 8000+ members but only 200+ contributed. I have been thinking about it and here is one possible answer. If you look at the poll result about whether we should push for 485 or not, there are about 280 guys supporting this goal. Maybe almost all recurring contributions are from this group. :confused:

Truly a tragic incident. There is no excuse, what so ever, to take someones life and to commit suicide. No matter what the hardship, it has to be faced and move forward. Indians are too emotional and take it so personal and worry more about what others think.

At what stage will my current job description be matched to the Job description in my Labor or I-140?
My I-140 is approved foralmost a year now and I had enquired with USCIS a few month ago and they told me my Name check has also been cleared and my case is just waiting I-485 adjudication when visa numebrs are available. I thought when my Priority date becomes current, I will get my GC seamlessly unless there is an RFE.
Also, is there any documentation that states 50% job description match? This is the first time i'm hearing this criteria. I do understand that if I work as Mechanical engineer, I should not chnage my job to a Software engineer...but will getting a Mechanical Engineering job in a totally different industry be a problem?

This is very subjective matter depends and how uscis handle your case. I think 50 % matching requirement is not written any where, it is just common practice .No one can expect us to match 100 % job requirement with old labor petition.
Mostly watch for your EB2 requirement with your job description. Here is the DOL web site link which talks about job description comes under that code.

does anyone have the bill number that was passed by clinton to recapture visas from previous years. i wanted to know who the sponsors for the bill were. if its was a simple bill maybe the state chapters can talk to their congresspeople about passing something similar in the interim. it will reduce the waiting time for everybody and it is certainly non controversial...just thinking aloud.

Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York

A friend told me about the E category visa for Australian nationals. Is this true?

You work for Govt on H1b. Payment would not be an issue. The only issue could be experince certificate. They might ask you to provide experience certificates.
NSC is really crazy about RFE. They complan about resource and they have time to issue RFE. 99% RFE's are cleared on first response.

It takes about 2 weeks get the RFE. It contains 2+ pages, first page is cover letter and second page+ will contain RFE details. NSC is know to issuing RFE on ability to pay, education (if 3 years degree) and detailed professional experience letters.
I have a 4 yrs BE (ECE) degree. so am not sure what could be the RFE. Do we also have to submit education evaluation for a 4 yr BE degree from Ind?

I was told that Sen. Pelosi did not directly endorse the bill, but she is fine with amnesty bills. I think we may finally see something cooking. If we don't, then chances are we need to wait till 2009 !!

Dude - think practically. If the billing rate that the company is going to get from the client is $70/hr and they keep only $5/hr then they have to give him $65/hr. If they have to keep him on the payroll, they will have to pay 7.45% in payroll tax, which is employer's portion of Social Security Tax and Medicare (reducing their rate from $70 to $65.1575). This means they will be making 15.75 cents/ hr (translates to $315 for a year assuming that you work for 2000 hrs - the remaining 80 hrs go in holidays - for which they may or may not pay). Even if they are outsourcing payroll, do you think that it will cost them less than $315 a year to pay him? even if it costs $0 - who would be willing to keep you on their payroll to make only $315 a year? Would you? and if you take unemployment insurance and liability insurance into account, the company would make a loss. If you owned a company would you follow this business model? If you are - you might as well just give your money for free to all your employees.
The only way you can get a company to keep $5/ hr and give you the rest is if you agree to a 1099 (and you cannot do that on a H1B - you need to use EAD for that). On a 1099 - there are other tax implications - now you have to pay both your share and the employer share of payroll tax (14.9%). And now since you are an independent consultant (which is what a 1099 is), you have to get your own Liability Insurance. To prevent people from suing you, you will need to form a LLC or some other type of corporation. You might want to get a good CPA to setup your company so that you can setup the right kind of company to benefit from the right tax deductions.
There is nothing wrong in making more money - just like you want more money, the corporations are out there to make money too. No one is in the business for charity. As long as the relationship between employee and employer is symbiotic, all is good. Once the equation changes, it is either time for the employee to say good bye to the employer or for the employer to off-load the employee from the corporate bus.
I have seen many posts in this forum complaining of "blood-sucking" employers and how they exploit employees. To me, that is the same as:
- programmer's guild complaining about us stealing their jobs or
- people losing their home and blaming the banks "for not disclosing terms"
- anyone who is blaming anyone else for their troubles
If you are being exploited, it is because you are willing to be exploited. Don't blame the employer. Blame yourself. If you don't want to pack your bags and go home when you lose a job and cannot get another one, don't blame the employer and tell others that they are "sucking your blood". Everyone is here to make money.

According to my attorney 2 things
1. You just need the receipts to travel not the Ap approval perse.
2. If your H1B petition is still valid, you are OK, if you notice the botton part of your petition is your original I94, so you are covered with that.
3. according to my attorney CIS will take 45 days for the RD to deliver the I797 notice to you home, so if you applied the last days of July, by the 3rd week of September you will receive the I797 notice.
As note my attorney was president of the AILA last year and her husband work in the CIS, so some how the info is trustable.

Every person must take the decision after consultation with a good attorney in AC21 matters and after looking at their own GC, Job, career and personal life situations. There are some areas like salary and same or similar job criteria that must be carefully looked at. There is no general answer to the question above. Each person must do what is best for them. It is speculated that a lot of people will invoke AC21 from next month after crossing 180 days and seeing that the upcoming visa bulletins will only push the dates back for countries like India and China. The Process of giving Birthright citizenship is a law called Jus Soli(14th Amendment) which was implemented in 1900's . Numbersusa and others are fighting to change the Jus soli to jus sanguinis which gives citizenship based on the child's parents Status to reduce the "Numbers".India Abolished Jus Soli in 1987 and dosent offer Birthright citizenship. I think going this Route to discuss the possibility to fight for parents naturalisation based on child's status will make us no different from Illegal Immigrants.

I had similar issue with my spouse H4, then I applied her H4 again before the I-94 expires on the pass port. In my case (h4) costed only $200, I didn't wanted to take a chance then applied and got the extension. If you want to safeguard your status, you better apply for H1 extension, if it is really expiring they will extend your H1 otherwise they might return saying you cannot apply for extension prior to 6 month of expiring.
So decide yourself, don;t ask peoples opinion too many times, you always get mixed results.
NOTE: according to my employer, I-94 given at the POE super seeds all the other form of I-94.
I visited my local USCIS office and the officer told me that they don't do I-94 updates and asked me to contact the CBP office. When I called them up to get an appointment, I got transferred to a lady who asked me the details. After listening to my case she said its perfectly okay and asked me to attach the new I-94 from the 797 to the passport. Is this true?
I am trying to get hold my lawyer but in vain. Please help!!!
