Yes, You can use EAD and start working on it before I-140 approval BUT you can not change employer using AC21 without an approved I-140 even if your I-485 is pending for more than 180 days.
Let me clarify some doubts people have on this thread...
It's your choice whether to use EAD or H1 to work,
You can change employer on EAD as well as H1(EAD is just easier, no application fee involved), provided your 485 is pending for 180 days and 140 is approved.
EAD does not give you the freedom to change employer if the other 2 conditions are not met(140 approval and 485 pending for 180 days). Once these 2 conditions are met, you can change even on H1....

My apologies, I thought I was making a point. The point was trying to see and realize that if USCIS was behaving with us this way it is, what would happen if it was a product selling company ? Could it do the same to its customers ? Could customers tolerate it ? Could USCIS have survived ?

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.
Anyway the smaller number of application is good news.

That is a sociological topic not immigration one. A person making his choice to try to settle here in USA or in India has nothing to do with this website. This website is for people who have already made a conscious decision to try to settle down here and obtain the Greencard asap which is the first step in that direction.
Making a choice between USA and India is something you have to do before you decide to contribute or join this organization.

As somebody said earlier, it's not right a forcing statement to make somebody donate. When I read the first reply of my email was not something which I asked advice but a dontation I was somewhat flustered. IT reached the limites when somebody mentioned cancel your trip of Bahamas and donate. Bharatpremi, I must say mind your own business, don't tell me what to do.
On top people have repped in wierd ways as well.
I would just say please mind your own business in these things if you don't want to give advice, dont act like some jerk and tell me what to do and what not to do..

Yes, what I conveyed was 'This struggle is (What IV has initiated) very important in your immigration life or my immigration life.' I do not know at what stage you are as far as immigration is concerned but if you are at later stage (2004 PD and afterwards) you will remember me in coming years. Yes, this struggle is more important for yourself right now rather than going to Bahama. And yes, if I might have that extra money meant for leisure I definately should have donated to IV and decided not to go to Bahama this year but I am not as fortunate as you are and that is a different matter.
And please take this as a very serious informative suggestion but not as a "intrusion in your life" or "advise". If you decide not to go to Bahama this year and instead would donate to IV ,you will certainly pat my back in future years (Probably while sitting on a beach in Bahama :)) for thinking good about yourself and your family.

I guess even after applying for leave of absence, If I am out of states for more that a year, there are high chances of triggering GC cancellation by USCIS.

Folks i got a LUD on my AP 7 days back and again LUD 5 days back. But the status didn't change nor i get any letter of so far.
Does this means i'm on my way to a RFE :) If they send RFE does that gets reflected on the Online Status ??

I had the exact same RFE. I'm on H1 since 1998, and you can imagine how many times I have left and entered USA. I have about 8 H1B extensions. Here's what I sent...
1). Cover Letter stating list of document to show evidence of law ful status in US.
2). I-94 card issued by CBP at the last port of entry.
3). ALL the H1B extension notices issued by USCIS. Its important that there are no gaps in dates on the extension/change of status notices.
4). passport copy containing all US visas and entry and exit stamps.
5). A document explaining the entry and exit dates matching the stamps in the passport.
6). Few pay stubs from the current H1B/green card employer that you are currently working.
7). Few W-2s for last few years.
Usually the I-94 that is on the extension of stay issued by USCIS is the same number thats issued by CBP at the Port of Entry. So, USCIS should be able to match the entry and exit information and extension of stay notices
I'm sure they know that one surrenders the white I-94 card when they leave US.

by law i think your company should pay for all G.C. related expenses..

who pays for GC nowadays? people are paying for their own H1B's. count urself lucky if your company is paying for you. most of the cases we are paying and being treated like BS from both lawyer and company in GC matter

Update:
The Doctor admitted his mistake.
He completely forgot to mark the TB test earlier.
He was ready to back date to avoid more inconveniance to me.
But I told him to be sincere in all aspects.
I basically forced him to give my wife a TB test again and also the x-ray.
Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
Hopefully they will mark the case as - resume processing.
If I were you, I would not have gone with the repeat of X-ray test unless it was absolutely necessary. X-ray are very harmful to the human cells and tissues. It was a ( Probably honest) mistake by the doctor who was going to give the correct report...and you forced him to take the x-ray again!! hmmmmm....I have nothing more to say.

Also, i received the EADs in mail, but haven't received the AP even though online status reads AP mailed a week back. Any idea how long it takes to get AP after it online status reads approved?

My category for I-765 EAD is -- (c) (9).
Now I am filing for my EAD renewal. Where should I send in my paper application -- Nebraska or Texas?
Would you all pl let me know. Last time my EAD was messed up big time, (wrong dates on EAD card), and I want to make sure everything goes normal this time.

If your I-94 expires you will be out of status ... it would be best if you take your new passport and travel outside immediatly before its expiration so that you can get a new I-94. The earlier IO probably didn't give you an I-94 till 2010 because your passport was expiring within 6 months.
I think you need to act on it urgently.
I have the same issue. My wife I-94 was issued based on her passport expiry date and not on her I-797 expiry date. I called up my attorney and she told that the best way to deal with this issue is to travel out of the country. If anybody had renewed it without making a travel, please post here.

If the other guy worked for the company atleast 180 days, then your employer cannot prove that he had no intention to work for the company. If the guy worked for only a short time or didn't work at all for the company, then the company can win the case.
The greencard of the other person will be rescinded. You can then use his labor.
We dont know all the details of the case. If the person who got 485 approved worked for more than 180 days for the sponsering employer.

The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.
Wait a minute; I thought the name check is part of the I485 approval (and for those who file I-140 and I-485 concurrently, part of the I-140 approval). It wouldn't make any sense if the I-485 is approved and they are still checking the identity.
