    Listening to EB folks is a win-win situation for both this country and the professionals. May be more win situation for the country than professionals.

    Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

    The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.

    My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

    Any Ball park amount I should expect as attorney fee for the MTR ? I know some one mentioned about a CA attorney who does it for $500 but since I don't have H1 as backup , incase if I need switch back to the 2nd employer it is better to keep the current attorney ( 2nd employer ) . looks like he may not come cheap . they asked whether I want to file for Adv parol and it will cost attorney fee $800 . ( I don't have a clue why asked when my I485 is in denial stage) .

    I looked at the I290B form and looks not so complicated.

    But in this situation I do not want to take the risk of filing myself .

    I-290B is pretty straightforward and I helped my friend with his filing and we were successful in getting his I-140 approval. Having said that, whether to self file or hire a lawyer will depend on the complexity of the case and the reason for denial. If its a straightforward case/denial (wrongful) and you have all the documents to prove it otherwise, you can go ahead and file I-290B yourself. Otherwise, hire a lawyer. Did you get the I-485 denial notice yet and whats the reason for denial?

    Does it mean they would stop processing I140 premium applications which have already been sent. My I140 was pending for 6 months and I changed it for premium after the dates became current, it was sent by my lawyer this Monday (25th) and received by USCIS on 26th. Does this mean it will not be processed or does this mean they will not accept any premium processing applications from July 2nd.

    Yours will be processed as you have already submitted. You should receive your decision in the next week. When you do, please let us know that it is approved :)

    I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
    my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

    You have to register the birth with the consulate (to get an Indian birth certificate) within a year using this form (see part II) (http://www.cgisf.org/visa/misc.pdf), following which you should be able to get an Indian passport. The USA will not issue a visa on this passport since it considers the child to be a US citizen. However, US policy in this regard does not matter if the child never travels to the US.

    Yes you are right and I was incorrect for base information but for this original poster it will not still work as he has already taken a US passport for his child and thus his child is now US citizen and so Indian citizenship will not be granted. Please see the content of declaration on the link what you posted.

    what you say above is true. but the fact is that we are what we are ..and we are at cross roads ..and that is where we are.
    the main question is how do we increase membership .. the answer to that has to be in meaningful and visible campaigns.

    I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    yes my case rejected due to number of years of education.
    My case they rejected because i have 3 year Bsc and 2 year master now funny thing is that i know my friend who did similar course from same university but he did same master degree like me but in part time so he complete in 3 years and he got approval in 2009.

    That's ridiculous :rolleyes: So did you pursue with MTR or filing in EB3?

    Folks, democrats are really serious about this bill. This hearing is not at the Immigration subcommittee level instead it is at the FULL JUDICIARY COMMITTEE level. That says, they are really serious about this bill.

    Also, in my previous response (quoted below), there is an audio link in which Senator Menendez clearly says something: This bill S 1085 is a pre-cursor to the comprehensive immigration reform. That means, this is like building a border, which is the pre-cursor that anti-immigrants are asking for. Anti-immigrants often argued that, before dealing with the Undocumented immigrants issue, we need to make sure the problems with the Legal immigration should be fixed and the laws should be enforced including border protection. Democrats are using that point to fix the existing problems of the legal immigration system as a pre-cursor to the CIR which will deal with the fate of the Undocumented immigrants.

    So, folks even if there is no chance for the passage of CIR this year, passage of a PRE-CURSOR bill is very much possible. Now the Full Senate Committee hearing shows something - Democrats are showing the will to deal with this issue (at least at the Legal Immigration front).

    Iron is getting hotter....May be it's just a matter of time to find out when we can strike.

    There is so much momentum - I think, IV should join this bandwagon.

    If groups supporting employment based immigration like IV are not there to explicitly support this bill, during the mark-up of this bill, our recapture clause could get eliminated under pressure.

    not personal, addressing many issues.

    1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.

    2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.

    3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.

    4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
    i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
    you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.


    there are various ways to contribute, money is just one of them- although very important. if you have not done this, join a state chapter and start meeting lawmakers in your area. get friends to join iv. put up fliers and posters in local grocery stores/fairs and festivals etc. there are many good examples of these activities being done successfully. in the end it's going to matter is whether we put enough effort to push over the line- whether it's today or in 2 years.

    we all have a choice. please make a wise one.
